Granting leave to enter

Subject to the requirements of the Rules being met, provided none of the general grounds for refusal set out in Part 9 of HC 395apply, leave to enter may be granted as shown below:

Students on courses of one year or more that finish in the summer (June) should be granted leave until 31 October following the end of the course. For courses that do not follow the standard autumn to summer pattern an additional two months leave should be added to the end of course date.

Postgraduate students should be given 4 months beyond the end of the course irrespective of when it finishes. (Eg. course ends 30 September, should have Leave until end of January.)

Short-term students, on courses of six months or less, should routinely be landed on Code 5N, prohibiting employment. However, there may be cases where the student specifically indicates that they wish to take part-time employment during these six months. In these instances, where the student fully meets the requirements of paragraph 57 of HC395, leave should be granted on Code 2.

For courses longer than six months, leave should be granted on Code 2 to cover the duration of the course.
